Regarding a recent post on Climbing magazine and payments for photos...adding to that . I heard the magazine had used one of my photos .I understood the mag was not too keen on payments so I did not expect any..However as I live in an area where the mag was not available I emailed the editor I believe a Ms Davies asking if they would mind sending me a copy of the said magazine. I received no reply or magazine. Such poor customer service is I think often connected to a business on the way out.

Send them a cease and desist letter and demand payment for your work. It's illegal to use another's photo for for-profit reasons without permission.

"not too keen on payments" is not the way magazines work. If they used your photo without permission, you can charge them what you want. If it was with your permission and not stipulated as free, they owe you their standard page rate at the very least.

In this case, you are not the customer, they are.

Either way, it will likely take you a year or more to get paid - but thats not endemic to all climbing magazines - just Climbing.

That's a bit ridiculous. I am surprised photographers actually do business with Climbing if that's how they roll. I couldent imagine anyone sticking around after being told their paycheck wont get mailed out for about a year.

Sounds like a major pile of dung. I sold a snapshot to a little Podunk magezine in the Adirondacks with probably 1/100000th of the viewership of Climbing and they paid me 70 bucks. They actually found it posted here on mp and contacted me to ask permission...I sent it not expecting anything just because it was an article and pic of my climbing mentor but then they insisted I give my address so they could pay me which they did in short order.....I can't believe a big mag like climbing would pull that shit...you deserve financial compensation for your creative property...the pics are 75% of the reason I buy a climbing mag...dang man

I vaguely remember John Strand having a problem getting paid for a pic / article a few years ago. Not sure what that outcome was or how long it took.

With that, if they used your pic without your ok that's really a shite thing to do - and they owe you! I'd certainly ask nicely and demand payment.

Just FYI, an old employer of mine used what we thought was a public domain photo in a brochure once and printed 10,000 of them. Owner of copyright somehow found out, contacted us and didn't want money and wanted them destroyed as they didn't want it used for commercial purposes.

I have sent two emails one to the editor and the other to customer service just asking for at least a copy of the mag . It was not an important photo but it would have been nice to have seen what they did with it .. Anyway they do not reply ...so what else can you do except learn ...

If you're emailing the editorial staff and getting no replies, then you are not emailing the right address. Mr. Shannon Davis (read: Shannon is a MAN) is a stand up dude who wants nothing more then to get you paid, contrary to how you may feel or what others may say. Email him at SDavis@aimmedia.com.

That was the email address I used to the editor requesting a copy of the magazine etc., I also emailed customer service ...again with no results . I have sent another email to the stand up dude ..

I know someone who got paid by Climbing for a photo... I think it was fairly quick and easy.... Although maybe I'm wrong -- Perhaps there is some confusion or you need to be working with the right person
