Gym Injury-Who is responsible

Did I miss somewhere in the thread that the pad was movable? I thought it was still an unknown. If it was a crash pad or bouldering mat then yes, I fully support the gym. But if it was a large mat that moved over time and needed staff to make sure this was adjusted correctly then I see where the girl has a case.
As for the legal documents quoted I have no clue what any of that means. Can you just say yes she has a case or no she does not?

I have to say it is redicilous to sue. You knew the risk going up. No case of gross negligence here. Most of those places say have a spotter. Maybe they should sue your friend for not having a spotter. Sounds rediculous? Cuz it is; just like you asking if you have a case. The fact that your asking means your friends seeing if there is something there. Seems fishy.

Personally I hate those movable pads though. Ankle breakers.

Personal responsibility is, to me, a sign of someone's character. Don't get me wrong, if someone is negligent I have no issue with them being punished financially with a lawsuit, but I also believe you and you alone are responsible for your safety in most cases.

So the question is, did someone's negligence cause her injury? I'd guess not entirely. Suck it up, learn from it, and move on.

If it's a trust-fund girl with no debt going to an elitist university, maybe the gym should sue HER.

If it's a girl with 6 figure debt going to a small local college (unlikely, to be fair), I think a lawsuit is not AS outrageous.
