$5000 and up to 5 years in jail? (Curious to see what the actual jail time is). Definitely seems like a punishment to me. I can't imagine having to come up with a sentence. You want there to be justice and have them pay the price for what they did, yet not permanently ruin their lives and the lives of their families.
(a) "Authorization" means specific written permission by, or contractual agreement with, the Division of Parks and Recreation.
(2) A person is guilty of a crime on state park lands and is liable for the civil damages prescribed in Subsection (5) if, under circumstances not amounting to a greater offense, and without authorization, the person:
(a) constructs improvements or structures on state park lands;
(f) intentionally commits an act that causes damage, defacement, excavation, permanent alteration, or destruction of any division resource
