Those of us who climb in Dream Canyon are acutely aware of the signs "discouraging" people from hiking up that loose gully to gain access to the area above the falls. I read one post about a ranger giving someone a ticket for this offense.
Far as I know it's "technically illegal" (you can't see the air quoting motion I'm doing, nor the wink).
My rule of thumb here is to be courteous (unless you're on an online forum), tread lightly, and if you get caught plead ignorance. I've been up there many many times, and never ran into trouble. Good luck, and I'd really be interested in finding out more about this access situation.
